Serna de la Garza's paper analyzes Mexican federalism from the viewpoint of the legal scope of globalization. Mexico, a federally organized country but with more of a centralist tradition than the other two cases, places foreign relations under the responsibility of the Executive Branch. Under this law arrangement, the author examines three basic dimensions linked to its exercise. The first relates to the powers of the federation, at the international level, to agree on topics than could clash with privileges and legal powers conferred to the states. The second refers to the external impact that the local governments' actions can have on their area. Finally, under the third dimension, the author wonders how decisions of the sub-national governments can jeopardize and affect international commitments undertaken by Mexico. The author concludes by reasserting the wide powers of the Mexican national government in the design and practice of its foreign policy. The Executive has no restrictions as to the commitments it can undertake, which are fully valid once approved by the Senate. Nonetheless, the author compares these features of institutional organization and regulations with a reality that moves forward along a double path. On the one hand, there is globalization, which calls for more activism and flexibility in foreign relations, and, on the other hand, there is the growing domestic democratization of Mexico which gives rise to more political activities at the local level. Once these analytical and conceptual elements have been established, the Serna de la Garza text addresses an interesting chapter on activities of federative entities and the international responsibility of the Mexican government within the framework of Chapter XI of the North American Free Trade Agreement NAFTA ; , which refers to the protection of foreign investment in the treaty's signatory countries. The author examines the cases of environmental conflict where the initial reaction of the sub-national governments has aimed at protecting local interests. Disputes were solved taking into account the international commitments acquired under the Agreement, rejecting the pertinence of sub-national claims. This analysis turns debate back to more general aspects on the necessary conciliation of interests in international negotiation processes, where the regulation of local public goods can be subjected to higher provisions and standards. The second chapter refers to The federal systems in the shaping of trade policy. Its purpose is to analyze the impact of the federal systems in the process of shaping a foreign trade policy, the restrictions which crop up and the possibilities of articulation between the National Government and the provinces. Once again, a common concern cuts across the theses of all three authors.
